Army Lt. Nazario’s attorneys seek new trial after verdict favors Windsor police officers.
NORFOLK, Va. — The attorneys representing Army Lt. Caron Nazario filed a motion for a new trial Friday, following a verdict by a jury earlier this week which awarded him less than $4,000 in a lawsuit in which he had sought over $1 million.
Jonathan Arthur, the attorney for Nazario, said while they were shocked by the outcome, they are not filing it just because they disagree with the verdict.
“It just does not look like the jury followed all of the instructions,” Arthur said.
Arthur argues the jury should have found more claims as liable after former Windsor police officer, Joe Gutierrez, was found liable for assault.

We also need to do away with Qualified Immunity in the United States for LEO's. So these LEO's can be personally held accountable – criminally and civilly when they break the law and or violate your rights. We have many LEO's out there that have an EGO problem and when their feelings get hurt go into bully mode believing they are above the law. Doing anything including violating laws and your constitutional rights to find any reason to arrest you. We are finding more & more LEO's on the streets today that believe they have the authority or right to break laws and or violate rights if that's what it takes to find a reason to make an arrest.
In addition to ending LEO's Qualified Immunity, they should be forced to purchase and carry LEO liability insurance so that taxpayers aren't on the hook for their negligence or ego when sued for their actions. When the law enforcement officials wont do their jobs and fire bad LEO's the Insurance companies will definitely weed out these bad LEO's when the insurance company keeps having to payout for the same LEO. The insurance premiums would be based on the LEO's actual personel record of behavior and complaints, not the number of arrests.
