The Gay Panic Defense



TLDR: I believe Etute used too much force to warrant self-defense but the jury disagrees. However, the defense never once brought up anything related to a ‘gay panic defense’ in their testimony, Etute’s feelings were focused on by the prosecution. The mentioning of Virginia’s new gay panic law was only for court procedural purposes, and only insofar as the jury was not instructed on the topic, and only because the law was not in effect at the time of the crime. But that’s what everybody latched onto on social media because it makes for a really good headline and viral tweet.

  3. Regardless of the sexual connotations this is more or less a self defense case. Now IF there is no weapon then this would be a solid manslaughter scenario if not a second degree murder. This should also be seen as how the LGBTQ crowd need to understand catfishing straight people into sex is a form of sexual assault. Not overt rape but sexual assault all the same.

  6. Sorry man but your take on this is garbage. Who are you to determine what is and is not excessive. He is an athlete compared to the fitness of an average or subpar individual such as yourself most likely he can dish out far more force with minimal effort. So he should be punished because he’s more capable of doing far more damage? That entire encounter could go down in 10 seconds not to mention it was in the dark so how is he to know when to stop swinging when his life has been threatened? There are even guides you can find online by unsavory members of the trans and crossdressing community that give step by step guides into tricking straight men that match the description of this scenario. Like keeping it dark and only agreeing to anal, and a common item on these lists is keeping a weapon such as mace or in this case a knife nearby so I have no doubt they intended to use the knife on him. And if we really break this down to the bare bones of the case this person was committing SA and had been repeatedly doing so for an undisclosed number of years, and then attempted to harm their current victim with a knife, and your arguing the victim should have been punished more. I’m sorry but frankly I find your opinion on this case disgusting and moronic. All that being said typically love your vids so keep ‘em coming but really reconsider the facts around this case.

  8. Smith was reaching for what Etute correctly assumed was a deadly weapon. Etute fought back with his fists and feet, which were also deadly weapons. Virginia does allow lethal self defense if you have reason to believe your life is threatened (like someone is reaching for a weapon)

    Etute did not need to wait to see the knife to know his life was in danger.

    If you don't like these laws Dev, stay in Canada.

Now, one doesn't need to put any effort in order to "identify" as another gender. Which makes a straight man, putting on a costume, adopting a pseudo name, and seducing straight men, a trans.     I believe the amount of force used was completely justified.

    If I turned my back on the assailant to run through the door but was unable to unlock the door while my assistant pulled out a knife or even a gun my life would be forfeit.

    The moment he tried to pull a weapon from underneath the bed it was a life or death situation.

  14. Here's the thing. I do find it extremely disgusting that this crossdressing dude basically had sex with these men on a false pretense. He basically said "fuck your informed consent, I deserve sex", so I do think it should in some way help with the other mans defense in this case, but ultimately this is a self-defense case. Crossdresser was going for a knife, black dude chose violence before becoming the victim of violence.

    Also nah, if you are stuck in a dark alley with somebody you think has a knife, use all the force necessary to get the fuck outa there.

The mere suggestion that someone who feel an immediate danger to his/hers life is supposed to exercise caution when fighting their attacker makes no sense whatsoever. When you have in mind that the gay guy who sexually assaulted him (in reality) was reaching for a knife I think that even if the SA victim stomped his head to death he would still be blameless.

  16. Respect the research as it is very interesting to look at these things and your usual opinions are appreciated since they are coming from a different direction that many only wish others would consider. However, you are very obviously in the wrong on this one.

    Pulling a knife on someone is pulling out a deadly weapon. If the moment you are pressuring someone into sexual acts by deception, and then go for a deadly weapon the moment you're found out, you are putting your victim not only in a quasi-rape situation since they would not have consented had they known which you purposefully deceived them about, but you are also are now putting their life at stake with a deadly weapon. They are unlikely to respond well after being violated and then had their very existence suddenly threatened. They are either about to be raped at knife point or killed or both. Whatever response they may have had is no longer unreasonable since it is a very unreasonable situation by its very nature.

  17. The problem with "excessive force" is that, how is someone supposed to know just how much is enough? What if that was a gun and not a knife? And what about other cases? Once one self defense was ruled as using excessive force what prevents other ones from also being judged as such? Kyle Rittenhouse was attacked by 3 men, but from what i know only one of them had a gun, was it excessive force that two of them (both without a gun) died, instead of him shooting their legs? What if someone jumps you without a weapon, do you need to understand the situation and then try to not hit them too hard? Are you even allowed to use anything in this situation? And who even says what is excessive force and what isn't?

  19. You should never presume "an appropriate amount of force" until a target is pacified.

    the crime is assaulting a target who is clearly pacified. but until that point and assuming it's a life or death scenario, any amount of force is justified. this is the same legal protections police officers have, and it's the same legal protections citizens should have.

    A few punches and face stomps to the face is completely warranted with a knife under the bed. infact i'd have done more.

  20. We'll have to agree to disagree. Once you pull a weapon, be it a knife, a cudgel, or a gun on somebody, you accept whatever they do to you to get away from you. If that means you literally get your face stomped in, that's what you get for using a weapon in an argument.

  21. The law of male on male self-defense and male on female self-defense is different so your “straight entrapment” analogy doesn't work. Also a dark room and a person reaching with prior knowledge of the land is far too dangerous. Lethal self-defense was warranted. Etute had no idea if it was a ranged weapon. Incapacitating the person is very difficult to effect for trained personnel let alone a scared teenager in shock and no optical information. Sorry, you can feel how you wanna feel but Smith set himself up for failure.
