Definitely plenty of ways to legally purchase legitimate MRE's. The company that makes the MRE's is privately owned and operated. Uncle Sam sets expected needs and volume of MRE's and when demand falls short what do you think happens to excess? Definitely not thrown away, and Uncle Sam also does not purchase excess. So it goes for sale through partners to recoup cost.

Rations are regularly given out through humanitarian efforts and older stock is regularly sold to the public. The packaging is emblazoned with that warning to deter soldiers from stealing and reselling them which is illegal but MREs and other US rations are legally bought and sold on a daily basis.
