Is it constitutional for the executive to connive with the judiciary to prohibit the labour union to, in the exercise of their fundamental rights and freedom of expression, to call for a strike action in expression of their grievances?
A strike action is a fundamental right under the ILO convention. Nigeria is a signatory to this international convention
The Labour Union should be bracing up to seak leave to appeal from the court's reasoned interlocutory decision, push forward the date of the planned action because of the legal constraint. Even if it takes another week for them to be put on notice and matter heard and determined, they should go on appeal and next day call up and commence their action, save provisional enforcement is ordered. This will be sufficient march to the manifest bad faith of the government!
