It doesn't make sense to file against the truck driver backing up, if the person who caused the crash was going 100mph there is no way the person just backing up onto the road could ever manage to keep the situation under control. They could have looked a dozen times while backing up for traffic but when a person is coming 100mph there's no ability to look out for that.
