Backers should be refunded if what was promised is not provided simple. They clearly have no intent on continuing with updates. Basic life circumstances are no excuse for taking money for something and not delivering on there end. That is for both the guys who took the responsibility of taking people hard earned money no matter how little. It’s not a charity it’s an investment.
I did not invest in this one but it really puts me off investing in anything Kickstarter. Which damages potentially great companies in the future.
Also cheers Ed for all the work you do behind the scenes to provide us with updates on this genre.
I am afraid this is the double edge of kickstarter most people don't comprehend that getting the money may not be the biggest challenge to a successful product whatever that is. For all the side eyes management gets it is planning that most small businesses fail at.
If what their supposed friend says is true seems like a reasonable assumption that the dev used the funds to help finance their collage degree.
That's why I never back stuff on kickstarter
I'm sure you already know this, But Rainbow Skies releases on the Switch today. It has Monster Taming elements.
To answer your legality question: unless they've changed it recently, I'm pretty sure Kickstarter's policy covers creators in the case that they can't deliver their product. I think it's to account for delays and changes throughout development, but ends up also covering those who just disappear with the money.
Backers essentially agree to a crap-shoot when pledging. I believe the responsibility of refunds is solely placed on the goodwill of the campaign runners. Otherwise, you just have to hope that your pledge isn't going to the minority of campaigns that aren't going to work out.
Hope everyone gets their money back cause it seems clear to me this game has been abandoned.

I think people are either intentionally or unintentionally using Kickstarter wrong. When these people ask for money, they should be asking for the amount that will get the project completed. It seems some of them are asking for an amount they they think they can get and just pray they get the amount they ACTUALLY need and when they don't, "Oops! We ran out of funding."
I think there needs to be transparency over what the money is actually paying for. If you're working full time, why do you need $10,000? Are you going to hire someone to do something for your project? If yes, have you actually found someone who agreed to that price and are they trustworthy enough to do it?
Or like in Final Stardust's case, a completely fake trailer is against Kickstarter's TOS. Fake trailers are not allowed. Games need a demo people can actually play. To accept people's money on a fake trailer and then claim they couldn't get a publisher begs the question of what did you want the money for to begin with if you needed the resources of a publisher to complete the game? I believe Dreamland did this as well where it was just animations and not actually playable.
I backed a project that made $63,000 and not one single update has happened since then and it has been a year. I'm convinced they took the money and ran.
Wow, this game looks really good too, i like the character creation options. Shame people can just up and dip on development with no repercussions

I'm sure in some jurisdictions they could be sued at this point, and even if they update if that update don't justify the time since last update the sue might process too….
So if you are one of the backers check your local laws and ask a lawyer too

@GymLeaderEd I think I was the one who told you about that game way back when, then immediately afterwards the creator disappeared , I was really disappointed because I really enjoyed the concept.
while a possibility is that the dev might be undergoing something in life, it is not cool to let everyone who backed this project in the dark for 6+ years in total.
i don't count the in between posts the dev put out because they basically all say the same thing.
"Hey guys, im alive, currently busy with life so ehh yea thanks for the money this really helped me getting on the right track."
meanwhile saying nothing about the game nor any concrete future plans or updates.
this game is ded. goner.

to add to it, i remember the covid time, a time we couldn't really be outside for prolonged time or at all in some regions.
why was this time not used and or invested into making the game and give the backers something for their money.
its mindboggling to me to excuse yourself behind something called covid.
