Putting moral and ethical arguments aside for a minute, this move by the ANC to hold other countries accountable according to the ANC's worldview, is not the view of many South Africans. Many South Africans want the ANC to put their energy into fixing SA, and not towards fixing other countries and their problems. In terms of South African citizens, we do not benefit from this stance taken by the ANC. Therefore, this is a self-serving agenda for the ANC, albeit that some in different parts of the world may benefit. The moral and ethical claims made by the ANC are not consistent with their previous track record. If the ANC were consistent, that would give their argument more solid ground. However, it is the ANC which is found wanting. Just think of genocides which have taken place elsewhere, and continue to take place i.e. Syria, Yemen, Sudan, China (China has an appalling human rights track record), Cuba, Venezuela, Zimbabwe, etc….Furthermore, every single election, the ANC declines, and more and more people become disappointed in the party. Whilst the ANC may get support from the Muslim community in SA regarding their stance on Palestine, they will lose support from those who are not Muslim.

Israel is standing on high moral ground. The people of Gaza were active supporters of the barbarism by Hamas on 7th October. You start a war and then cry ceasefire. South Africa should talk about the genocide of white farmers. They should talk about their racism and apartheid in government policy. This was something we thought ended in 1994. It is now more entrenched than was had in Apartheid South Africa. The South African government should also talk about its corrupt governance instead of following Islamic agenda. The ICC's case will not affect South Africa's case in the ICJ. The two courts have different purposes.

All Middle East and international law experts agree that South Africa has a slam dunk case because the Israeli governmental leadership are on record stating their intentions quite explicitly in this, the most recorded and documented genocide in history. The written and audiovisual record is quite clear and investigations should not take years. In fact, South Africa is asking for an interim order of cessation to stop the carnage, and that could take days, not years.
Both Israel and South Africa are signatories to the Genocide Convention, so jurisdiction of the ICJ to hear the matter is clearly established. Even Israel has acknowledged that fact. Also, the ICJ advised in 2004 that Israel, as an occupying power, has no right to self-defence against the people whose land it occupies and its current actions stand in violation of established international law.
The ICJ deals with disputes between states on matters pertaining to violations of international law while the ICC prosecutes individuals accused of war crimes and crimes against humanity. So, their responsibilities are quite distinct from one another. The ICJ holds states accountable while the ICC holds individuals accountable.
The South African case is well established, but we have to recognise that the ICJ’s 15 judges are effectively appointed by the UN Security Council and are not immune from the political influence of their appointees. The greater danger is that, because the ICJ is an arm of the UN, it takes only one permanent member to veto the judgments of the ICJ, and we can already bank on a rejection from the US and the UK, while France, Russia, and China may simply abstain for reasons completely different from that of the US and the UK.
The latter two will do so because they don’t respect international law unless it suits their agendas, and that is why Israel can do these things with impunity and have gotten away with it for more than 75 years!
The less said about the ICC, the better! It is the captive instrument of Western imperialism, focusing 99.9% of its prosecutions on Africans only, and in Eastern Europe based on who the West’s perceived enemies are. The Palestinian Authority has filed a complaint with the ICC back in 2008 already and to date nothing has come from that complaint. Only in 2021 — 13 years later — did it report that it would conduct an investigation into Israeli war crimes but has not done anything in that regard almost three years later. Yet, it acted with speed in issuing an arrest warrant against the Russians for their 2022 invasion of Ukraine. So, its credibility is seriously in question.
