The state of Texas has FAILED MISERABLY at enforcing BUILDING CODES.
There is a ‘so-called builder’ – in Bonterra at Woodforest – in Montgomery County – – that needs to be 🛑STOPPED 🛑 NOW.
They built me a POS in 2020.
I purchased land at what was the top of the hill.
They dug my front yard into a bowl – which meant I had extreme propensity to flood in under a 2” rain.
That was prior to them elevating the lot to the north of me – by about 5 – 6’ – and sending all of that runoff ILLEGALLY my way – – as if from an elevated river.
They also elevated the house to the west – – and have those downspouts Discharging their runoff under – and thus eroding under my foundation.
The ‘so-called hoa’ rules / The Declaration of Covenants, Conditions, Restrictions for Woodforest are CLEAR
– “all local state and federal rules and regulations regarding drainage and run-off are” to be “met.”
Texas Minimum Construction Standards Section 2.3 Drainage states:
“Surface drainage shall be diverted to a storm sewer or other approved point of collection that does not create a hazard.”
“Downspouts shall discharge water at least 5’ from the foundation.”
“Special care must be taken to not discharge water onto adjacent properties.”
There is so much more I could say.
I abandoned the house on November 16th of 2022.
The ‘so-called builder’ run ‘so-called hoa’ is trying to force me to remove the FLOOD prevention Earthen Berms – that are saving that house – and the houses behind me.
Mine is not the only house – that they have compromised in that area.
I think the federal government needs to start reading – all of the cases that have been attempted to be brought against that ‘so-called builder’.
