    2. In police training, if people refuse care and you have a reasonable suspicion that they need it urgently, they will do it no matter if you gave consent or not. Saving lives is more important.

  3. An alert patient is allowed to refuse care as long as they’re not a juvenile, and then the provider is not liable, nor is the department liable for any injury or death that occurs after refusal of care
    However, if the provider believes that the patient is drunk, that means they are no longer alert patient and they no longer have the right to refuse care

  4. The problem ultimately comes down to if you suspect someone of impairment AND you state they show all the signs of impairment they cannot refuse medical attention. You’re not in the right state of mind and are thinking clearly since your body is altered. She should’ve still taken his vitals and made him go to the hospital which here in NY you’re allowed to do.

So for this lady its an easy lawsuit she followed all the rules the second he refused treatment shes off the hook. I get its a show but ive watch this type of shit happen. She will win that lawsuit with easy on top of if i was here i would record everything you do just incase the retaliate agianst her she will have even more of a lawsuit

    Yeah, sure and your Uncle is Jesus Christ…the irony is stuff like that does happen and is one of the reasons Emergency Services (LE, Fire & EMS) are going for bodycams & dashcams. Audio recording devices at minimum! Because of egotistical trash humans like that. Which in my, and many people whom I know, experience are almost EXCLUSIVELY Democrats.

After my Grandpa died when my grandma was cleaning up after him she found a shoebox when she started to go through the shoebox she realized the man that she was married to for 40-plus years was not the man she thought he was that shoebox was filled with cp just because your family thinks you're a good person does not mean you're a good person

  9. I work in the ER. This entire scene is bullshit.

    When you are intoxicated and suspected of having traumatic injuries, you cannot refuse care. You are not legally competent to make decisions for yourself, so we have to make them for you. He needed care. She refused to provide it. His positive test for alcohol and other substances only makes this case worse.

    She should lose her job, her license, and go to prison for medical malpractice.

    the patient verbally refused care so legally speaking there was nothing she could have done in that moment. medical care may only be carried out over the patient if they submit verbal or written consent. in any other situation, nothing can or may be done.
    the dude clearly said "no i do not consent to medical treatment" and so the fact he died his his responsibility and his alone.

    therefore the lady getting taken off duty is, by all accounts, a whole bunch of nonsense.
    I know it's a TV series but this is flatout unrealistic.

  11. Technically an EMT has the legal responsibility to intervene in life-threatening situations. It doesn't matter if you refuse treatment, the EMT is obligated to treat you anyway if they believe your life is in danger.

  12. EMT’S and firefighters should wear body cams to avoid shit like this from happening. She wasn’t taken off of active duty because she did anything wrong. She was taken off of active duty because her boss didn’t want to piss off the victim’s influential mother.
