I’ve seen this video multiple times. It’s shameful that police will lie to get their arrests, shameful that DA will prosecute such a case and very shameful that the DA would help bury the truth with terrible evidence. Im proud to know there’s still some u biased judges out there willing to step up and do their jobs.

The judge gave them the first conviction, despite his own reservations.
Then he gave the prosecutor a chance to walk away from pursuing the defendant further, and she emphatically refused.
So the judge rightfully overturned the conviction and put a stop to the prosecutorial nonsense.
If the state wishes to appeal, they face the uphill burden of proving he was wrong first before pursuing the charges.
Notice how he doesn't scold the prosecutor for trying to talk over him. This is how the system is biased. The judge knew the government messed up and he called them out on it….on principle. However, the prosecutor tried to dismiss the obvious mishandling of the law by cops and still wanted to proceed. The judge did the right thing on the case but should have hammered the prosecutor for talking while he was talking.
Wish Miami had more judges like this. That Prosecutor is a POS.

Listen closely everyone the judge refused to overturn the conviction for driving while under the influence until he got to the second charge of driving with a suspended license he then asked the prosecutor to not go forward with that case and when she refused he admitted that the reason she caught the suspended license charge is because of the bogus DUI charge the reason is because the cop lied and when that prosecutor refused too drop the charge he told her then are you gonna bring the cop up on perjury charges because he lied on the citation the judge doesn't go in depth of what the officer lied on but it was the breathalyzer test and she did not take a blood test that was proven in court and when it was officer Wagner recanted his statement on the DUI report which he originally said she was over 0.8 and also admitted she did not take the test but showed signs of being drunk her lawyer objected saying it was insufficient tests and asked for her case to be overturned because of lack of evidence but the judge said no this case is not based off of purely circumstantial evidence that means something that is based on information which suggest something is true but does not mean that it is true in other words saying. I know your right but I'm not gonna do it Evan though I have no evidence either saying she was drunk Evan the prosecutor admitted the cop lied by saying he made a mistake on the report but also do not go into depth of what he lied about the only reason that the judge overturned the case is because the prosecutor did not do what he said in not going forward with the second charge of driving on suspended license. If the prosecutor would have dropped the second charge the defendant would have been convicted falsely of driving under the influence and the judge would have never over turned the DUI case .So that means stop praising this judge because he is just as corrupt as the prosecutor y'all are not listening too the case people in these comments are just praising him because he went off on her he is not a good judge and should not be in a court room
