That was a good cop where I live, here they would continue to arrest you after they find out that its root beer, and you would be convicted because the officers testimony is all the evidence they need. I wander how many DUIs where convicted because this officer said he smelled alcohol? Think how many people got rich that should not have, and how much money they made off of bad convictions alone.
This cop simply seen the brown paper bag and went from there.

There was no way he could smell alcohol.

Any other occupation like a medical professional or a legal person or a teacher, they would lose their licence! But not the police. Sometimes all that happens is nothing. If you do manage to get them fired they just move to anothe jurisdiction. Should be a police offenders register, like a sex offenders register.

New Mexico is a NO Qualified Immunity state. Arrest for a "hunch" is Clearly Established law for violation of Civil Rights.
The way he struggled to say "Reasonable Articulable Suspicion" could be ammunition used by the officer to detain on belief of intoxication. This is why NOT TALKING is so important.
You need to ask for a supervisor and tell him you could smell dope from the cop.
Once an officer verbally declares "You are under arrest" while using his authority to go hands on, then he opens himself to civil action because the arrest is then actualized, whether he gets cuffed and booked or not.

Isn't falsely claiming they can smell alcohol/cannabis falsifying evidence? I'd love to take these types of cops under Oath and see if they can tell the difference between certain smells in a deposition..
