I agree with the lawyer (second case) that there is reasonable (significant?) doubt in the results of administering field sobriety tests on someone who has literally just stepped out of a car that was totalled after being hit on the driver's side. Lots of injuries show up after the adrenaline subsides. He is bound to be confused and in shock and disoriented. It is probably wiser to take him to the hospital and get him checked out and at the same time do blood work. The blood work is going to be much more solid evidence against him in the law suits he is probably facing.

The Drunks rarely get hurt badly! Im a retired Paramedic. I lost my 18 YO SIL to a Drunk Driver. She died on impact and her friend was also injured. The 17 yo that hit her head on was fine! That’s how it was most of the time when I was working. Drunk Drivers barely injured and innocent people dead!!

I believe part of the problem is that so many people get away with it so often, they become accustomed or perhaps immune to the risk. Most people do not drive drunk. They are driving buzzed. Which puts them well over the limit. But they don’t feel like they are drunk. It should not be called drunk driving. It’s simply under the influence.
