RE: Cease and Desist Demand Regarding Systemic Racism, Misidentification of Cultural Heritage, and Violations of Constitutional and Federal Laws
I. INTRODUCTION
The Plaintiffs—AMERICAN INDIAN EMPOWERMENT PAC, Marquez Ally Orion, and Jiles McCloud—hereby issue this formal complaint and demand for an immediate cease and desist against the unlawful and unconstitutional misidentification of Americans of American Indian and Colonial European descent as "Black" or "African American." This misidentification perpetuates **systemic racism, cultural erasure, and is in direct violation of federal statutes, including RICO, Commerce, and Fair Banking Codes, as well as constitutional protections.
II. BACKGROUND AND LEGAL BASIS
It is imperative to recognize that no person or entity—whether Fraternal, Religious, Judicial, Legislative, Administrative, Corporate, or Natural—nor any of their agents, has the legal or lawful authority to impose racial integrity laws or perpetuate systemic racism for influence, control, or profit.
This formal complaint references violations under:
– 5 U.S. Code § 3331 (Oath of Office)
– 28 U.S. Code § 453 (Oath of Justices and Judges)
– Indian Civil Rights Act of 1968 (25 U.S.C. §§ 1301-1304)
– Public Law 93-638 (Indian Self-Determination and Education Assistance Act)
– Racketeer Influenced and Corrupt Organizations Act (RICO)
– Federal Commerce Regulations
– Fair Banking Practices Codes
These laws exist to ensure fair treatment, justice, and the prevention of fraud and unlawful racial categorization.
III. HISTORICAL CONTEXT
The Racial Integrity Laws, Indian Removal Act, and policies of forced assimilation contributed to the erasure of the cultural identities of American Indians and Colonial European descent Americans. The continued misidentification of our community as "Black," "African American," or "People of Color" directly revives these destructive practices, violating constitutional, treaty, and federal protections.
IV. SYSTEMIC RACISM AND FRAUDULENT MISIDENTIFICATION
The continued practice of labeling Americans of American Indian and Colonial European descent as "Black" or "African American" perpetuates systemic racism and violates federal statutes by:
1. Erasing cultural identity and heritage;
2. Violating constitutional, treaty, and legal protections;
3. Reviving the now-defunct Racial Integrity Laws;
4. Undermining self-determination and accurate self-identification;
5. Constituting fraudulent misrepresentation in violation of RICO statutes.
Additionally, this practice:
1. Ignores the historical and cultural significance of American Indian and Colonial European descent Americans;
2. Perpetuates a false narrative of a monolithic "Black" or "African American" experience;
3. Facilitates illegal commerce under federal laws by misrepresenting cultural identity for profit and political gain;
4. Contravenes fair banking practices, as individuals are often denied equitable access to resources based on racial mislabeling.
V. DEMANDS AND REQUESTS
The Plaintiffs demand the following actions immediately:
1. Cease and desist from using terms such as "Black" or "African American" to misidentify Americans of American Indian and Colonial European descent in any public, commercial, or governmental capacity.
2. Remove all records, content, and references in any form—be they social media, government records, or corporate documents—that inaccurately describe our people under false racial terms.
3. Publicly acknowledge and correct any misrepresentations that perpetuate systemic racism and violate constitutional and federal protections.
4. Conduct an audit of entities involved in such misidentifications to ensure compliance with federal law and prevent future violations.
VI. VIOLATIONS OF FEDERAL CODES
By engaging in racial misidentification, the defendants are not only perpetuating systemic racism** but also engaging in activities that violate numerous federal statutes, including:
– RICO (Racketeer Influenced and Corrupt Organizations Act)** for fraudulent racial misclassification aimed at profit and influence;
– Commerce Regulations, as these misrepresentations directly influence financial and commercial transactions;
– Fair Banking Practices, wherein racial mislabeling impacts individuals' access to resources, loans, and other financial opportunities, thus constituting discriminatory practices.
These violations represent an ongoing effort to maintain de facto systemic racism, which contradicts the core principles of liberty and justice as outlined in the U.S. Constitution and relevant federal statutes.
VII. CONCLUSION
The Plaintiffs, AMERICAN INDIAN EMPOWERMENT PAC, Marquez Ally Orion, and Jiles McCloud, formally demand the immediate cessation of any and all activities related to the misidentification of our cultural heritage. Continued violations will result in legal action to enforce compliance with federal laws and constitutional protections.
Failure to comply with this demand will leave the Plaintiffs no choice but to pursue further legal remedies, including but not limited to civil litigation under **RICO, Commerce, and Fair Banking statutes, and constitutional provisions safeguarding our rights.
