Lower courts are simply instruments to procure funds for the county, city, etc… they can care less about law or legalities. As you go up the ladder of courts and up the ladder of the amount it will actually cost you the defendant then it gets slightly sightly better. Although little by little even that is hard to come by (especially for most people just trying to get by) "judicial" system is trash and broken for we the people. When our government can weaponize the judicial system to go after a presidential candidate and former president to try to change the outcome of a election which is one of the charges they charged him with what makes people think they won't do it to us and I'm not big fan of trump but that doesn't make it right same government and political party that said a jury wouldn't convict Biden because of his mental capacity but then will turn around and say his fit to be president so a guy with a camera gets locked up for exercising rights but a guy with a rifle can setup on a roof 150 yds from trump with hundreds of law enforcement different agencies and get shots off all while the people are yelling that he was there

I thought you could record in a city building, but not necessarily where the city employees are actually working like in the office is for example. But I’m thinking if you go into like let’s say a police department and you film at a counter where it’s open to the public you may be able to film the employee that helps you at the counter, but you can’t walk behind the counter that is not accessible to the public And start filming so I’m thinking there are certain areas within the buildings that are considered public that are acceptable to fill. I know in Los Angeles even the homeless can sleep on the benches inside the police station where the public is supposed to be sitting waiting to be seen by law enforcement, and the officers are not allowed to ask them to leave Because it’s a public building

With all due respect Sean: As an attorney myself, I can tell you that your "facially insufficient" claim lacks merit. You may be correct that the law is unconstitutional, but this particular claim lacks merit. All they need to do is allege that you were there unlawfully and they meet this very low burden of being facially sufficient. On your second claim of the Mayor's "lack of authority", you use conclusory language. "It wildly exceeds", you essentially say the order exceeds his powers, therefore the mayor exceeds his power. Ideally you would need to present examples of OTHER "legislative enactments and compare that to executive order. It is not persuasive to say "there is no legislative enactment that would allow him to do that". The court cant take your word for that. Simply having case law that is not completely applied, is not persuasive. you have a VERY high burden in a Motion to Dismiss because you are essentially asking to win without a trial. You may have some merit to your claims, but they are not so overwhelming that the judge should throw it out altogether. Think of it this way: Would you want the court to be able to make a summary judgment against you, convicting you without a hearing? You are asking for the same type of relief by having this motion granted without a trial. Therefore, your burden is very high.
